Privacy Policy

1.1 Data Controller. PixelNuvex, registered at 60596 Gartenstraße 33, Frankfurt am Main, Germany, is the data controller responsible for processing personal data submitted through our digital platforms. Contact: [email protected].

1.2 Data We Collect. When you submit a project brief or inquiry through our configuration console, we collect: your full name, email address, phone number, company name (optional), project scope preferences, budget range, and project specifications. We also collect standard server logs including IP address, browser type, and access timestamps.

1.3 Purpose of Processing. Personal data is processed exclusively for: (a) responding to your project inquiries and delivering technical proposals, (b) executing contracted design and development services, (c) maintaining ongoing client communication, and (d) statutory tax and accounting compliance under German commercial law.

1.4 Legal Basis. Processing is conducted under Article 6(1)(b) of the EU General Data Protection Regulation (GDPR) — performance of a contract or pre-contractual measures — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

1.5 Data Retention. Contact and project data is retained for 24 months after last communication. Contract-related data is retained for 10 years per German tax retention requirements (AO §147). Server logs are automatically purged after 90 days.

1.6 Data Sharing. We do not sell, rent, or distribute personal information to unauthorized third-party brokers. Data may be shared with: (a) hosting infrastructure providers operating within the EU, (b) payment processors for contracted services, and (c) tax advisors under professional confidentiality obligations.

1.7 Your Rights. Under GDPR Articles 15–22, you have the right to: access your data, rectify inaccuracies, request erasure ("right to be forgotten"), restrict processing, data portability, and object to processing. To exercise these rights, contact [email protected]. You also have the right to lodge a complaint with the Hessian Data Protection Authority (Hessischer Beauftragter für Datenschutz und Informationsfreiheit).

1.8 International Transfers. All personal data is stored on EU-hosted infrastructure. Should any processing occur outside the EU/EEA, we ensure appropriate safeguards through Standard Contractual Clauses (SCCs) per GDPR Article 46(2)(c).

Terms of Service

2.1 Scope. These terms govern all digital design, development, and consulting services provided by PixelNuvex, registered at 60596 Gartenstraße 33, Frankfurt am Main, Germany. By submitting a project brief, you agree to these terms.

2.2 Statements of Work. All services are governed by explicitly contracted Statements of Work (SOW) executed between the Client and PixelNuvex. Each SOW defines scope, deliverables, timelines, pricing, and acceptance criteria.

2.3 Intellectual Property. Upon complete settlement of agreed invoices, PixelNuvex assigns all worldwide intellectual property rights in client-specific deliverables — including source code, design tokens, digital assets, and documentation — directly to the Client. PixelNuvex retains the right to display anonymized case studies in its portfolio.

2.4 Payment Terms. Invoices are payable within 14 days of issuance unless otherwise specified in the SOW. Late payments accrue interest at the statutory rate per German BGB §288. Projects may be paused after 30 days of non-payment.

2.5 Client Responsibilities. The Client is responsible for providing timely feedback, content assets, and access credentials necessary for project delivery. Delays in client input may shift delivery timelines proportionally.

2.6 Limitation of Liability. PixelNuvex's total liability under any SOW shall not exceed the total fees paid under that SOW. We are not liable for indirect, consequential, or incidental damages. This limitation does not apply to cases of gross negligence or willful misconduct.

2.7 Confidentiality. Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement by 24 months.

4.2 Partial Work Refund. If a project is cancelled after work has begun, PixelNuvex will provide a detailed timesheet and deliver all work completed to date. A refund of unused pre-paid fees will be issued within 14 business days. Work already completed is non-refundable.

4.3 Deliverable Disputes. If a deliverable does not meet the specifications defined in the SOW, the Client must notify PixelNuvex within 14 days of delivery. PixelNuvex will remedy any discrepancies at no additional cost within a reasonable timeframe. If remediation is not possible, a partial refund will be negotiated in good faith.

Governing Law & Dispute Resolution

5.1 Governing Law. These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

5.2 Jurisdiction. For disputes arising from or in connection with these terms, the place of jurisdiction is Frankfurt am Main, Germany, unless the Client is a consumer, in which case the statutory place of jurisdiction applies.

5.3 Alternative Dispute Resolution. The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. PixelNuvex is not obligated to participate in arbitration proceedings but is willing to engage in good-faith mediation.
